- The clauses within these General Conditions apply to both parties and form an integral part of the purchasing contract which becomes effective from the moment that the client agrees to the request, through the contracting mechanisms which will be specified below, in compliance with what is given in art. 1.255 of the Civil Code which compiles the autonomy principle for wishes and agreements between contracting parties.
In order to guarantee all rights for consumers and users of the Musikene purchasing service, these General Conditions are established in compliance with what appears in General Law 26/84, dated 19th June, to Defend Consumers and Users, Law 7/98 dated 13th April, on General Contracting Conditions, Law 7/96, dated 15th January, for Retail Market Ordinance, Civil Code, Directive 2000/31 CE by the European Parliament and European Council dated 8th June, Law 34/2002 dated 11th July regarding services from an information and electronic commerce company and standards which develop them.
- Pricing policy: Musikene reserves the right at all times and unilaterally to modify the price of products and services offered on its website. In order to guarantee clients the certainty and security of its product prices, this will be the price currently appearing in the advertising at the moment when the order is formalised by making the corresponding payment.
- Anybody can browse and look at products by Musikene.
- Customers will have to be registered, in order to place an order for any product from Musikene.
- It does not cost anything to register with Musikene. Clients can access their personal data, using a password, and can modify their data at any time. The aim of registering is to be able to send products and offers and for billing purposes.
- Registering means we can give you a more personalised service. The information which we receive when you register will be completely confidential and nobody outside Musikene will have access to this information.
- The registered person who makes an order on a product from Musikene and receives confirmation for this, either by email or via their Monitoring Page, accepts that a contract has been formalised under Spanish law and in the Spanish language.
- Purchasing subject to final collection: Musikene’s commitment to sell and despatch the goods on offer is subordinate to the stock of the product on offer and its availability until it sells out, so that Musikene, in its client quality and service commitment, attempts at all times to make sure that the advertised products are available. However, should exceptional circumstances concur involving interactive multiple orders or other circumstances which cause a product to sell out, the order and the contract signed between the two parties will have no effect by virtue of this cancellation clause, returning all money to the client which had been pre-paid without requiring either of the parties to pay an indemnity for not fulfilling a contract, consequential damage or lack of profit.

- Before being able to place an order with Musikene, you will be asked for your name and password. You will also have to accept these Sales Conditions before being able to confirm the order.
- The amount of the product along with the postage and packing will be charged to your account in Musikene, via your Shopping basket, when making the order.
- When you make an order or a reservation, it is understood that you accept the SALES CONDITIONS presented on this page.

- Payments can only be made using a Card: Visa, Maestro or Master Card.
Credit Card payments are only accepted if the purchase is secure, meaning when the cardholder has been checked. |
Delivery and despatch time |

- The order will be delivered to the main entrance of the place indicated by the client and a signature and ID will be required to collect the goods.
The client is responsible for checking the contents and the condition at the moment of delivery, as when it has been accepted and they have signed the copy of the delivery note to return to the transporter they are showing their compliance with what they have received and renouncing later complaints regarding the suitability and identity of the goods which were requested and received. Should the client note errors in the order they have received at the moment of delivery or that they are visually damaged, these circumstances must be described on the delivery note for the transporter and Musikene must be made aware of these facts within 24 hours.

- Claims for possible incidents such as the product being delivery damaged, broken, wrongly or for another reason which is susceptible to claims, the following steps will be taken:
* Note down any product anomaly on the delivery note when it is delivered. If it has not been possible to note down this fact on the delivery note, please contact us, by email or fax, the same day as the delivery or in any case within 24 hours of delivery.
* Take into account the following transporter rule: The DELIVERY NOTE justifies the condition of the goods. The consignee will be obliged on delivery to state whether the delivery is damaged and if the order is complete. Claims will not be admitted if the delivery notes do not reflect this and if the complaint is made more than 24 hours after delivery. A delivery note must not be signed before the goods have been received. If the delivery person says that this is not the case, do not accept the delivery or please state this fact on the delivery note.
* In the event of replacing a defective product: Musikene promises to deliver another product to collect the defective product from the client and replace it in perfect condition. In the event that this change cannot be made, all money which was paid in advance will be returned to the client.

- Your data is only used to complete your purchase. Musikene assures you that they will never use your data for any other purposes than the above, nor will they surrender your data to anyone under any concept. Musikene has been entered in the General Spanish Data Protection Agency Register.
